Vietnam Drafts Special Mechanism to Handle Economic Violations

Vietnam's National Assembly is deliberating a draft resolution that proposes special mechanisms and policies to address legal violations within state-owned and private economic sectors. Minister of Public Security Lương Tam Quang presented the draft during an extraordinary session of the 16th National Assembly on August 3rd.

The proposed resolution intends to overcome practical difficulties and encourage officials who are dynamic, creative, and willing to take risks for the common good. It also emphasizes the Party and State's leniency, suggesting that punishments should be determined by political, economic, and social outcomes. The drafting process involved seeking opinions from provincial People's Committees, relevant ministries, and Party agencies.

The draft resolution outlines core principles: protecting dynamic and creative officials for the collective benefit, offering leniency for violations committed in the common interest, prioritizing economic, civil, and administrative measures before resorting to criminal prosecution, and strictly punishing any exploitation of the resolution for corruption or waste.

Regarding criminal proceedings, the draft includes provisions for not prosecuting, excluding, temporarily suspending, or exempting criminal liability for individuals facing risks due to the application of science, technology, innovation, or digital transformation. It also details disciplinary measures for officials, civil servants, and armed forces personnel.

Phan Văn Mãi, Chairman of the National Assembly's Economic and Financial Committee, expressed general agreement with the necessity of the resolution. He believes it will help institutionalize Party policies, resolve difficulties in handling cases, and protect innovative individuals. Mãi noted that the proposed mechanisms align with the Constitution and international treaties, though he acknowledged the draft's unique and specific provisions.
