Vietnam proposes waiving compensation repayment for public servants in select cases

Vietnam's government is considering a proposal to waive the requirement for public servants to repay state compensation in certain circumstances. The Ministry of Justice has put forth a draft law that would allow for exemptions in cases where officials have made significant contributions, suffer from serious illnesses, or face prolonged severe economic difficulties due to natural disasters or accidents.

Minister of Justice Hoang Thanh Tung presented the draft law to the National Assembly, explaining that it aims to amend and supplement existing regulations on state compensation. The proposed changes are intended to ensure legal consistency, resolve contradictions, and align with legislative practices. The draft law includes provisions that would allow for the non-repayment of compensation under specific, clearly defined conditions.

One notable aspect of the draft is the provision for individuals who intentionally cause damage but are not criminally prosecuted. In such cases, the repayment amount would be capped at 50% of the state's compensation, with the individual responsible repaying between 30 to 50 months of their salary at the time of the repayment decision.

The draft law also defines who qualifies as a "public servant" for the purposes of this legislation, including those appointed or elected to state positions to perform administrative, judicial, or enforcement duties. The legislative committee's review suggests a division in opinion, with some favoring a more flexible approach to determining compensation liability in light of changing circumstances, while others advocate for maintaining a centralized and consistent framework within the State Compensation Law to ensure transparency and feasibility.
