Man avoids prison after fatal stabbing

A man in Lautoka, Fiji, has avoided immediate jail time after being convicted of manslaughter for a fatal stabbing. Rishal Kumar was sentenced to one year, 11 months, and five days imprisonment for killing Apakuki Tavodi in January 2024. However, High Court judge Justice Sunil Sharma suspended the entire sentence for two years, citing the circumstances of the attack.

The court heard that Kumar was allegedly attacked by Tavodi outside a supermarket after Kumar refused to hand over his shoes. The confrontation escalated into a struggle over car keys, during which a flip knife inadvertently opened, and Kumar stabbed Tavodi in the stomach. Tavodi sustained severe internal bleeding and later died in the hospital.

Justice Sharma acknowledged the seriousness of the offense, noting that a life was lost. Nevertheless, he highlighted several mitigating factors in Kumar's favor. These included Kumar's age of 20 at the time of the incident, his clean criminal record, his expressed remorse, and his cooperation with the police. The judge also considered that the deceased was the aggressor in the unprovoked attack on Kumar.

Kumar's guilty plea was accepted, and his sentence was reduced based on his good character and personal circumstances. Defense submissions noted that Kumar is married with a young child and works as a construction worker. Justice Sharma emphasized the importance of rehabilitation and stated that the compelling circumstances, including the unprovoked nature of the attack and the absence of aggravating factors, justified giving Kumar a second chance. Kumar was also credited for time spent on remand, and he has 30 days to appeal the decision.
