Polish court: Golden politician statue not a deductible business expense

Poland's Supreme Administrative Court has ruled that a gilded statue of a prominent politician, purchased by a tax advisory firm as a satirical marketing tool, cannot be claimed as a business expense. The court's decision on Wednesday concluded a tax dispute with a humorous undertone.

The case originated from a request for a tax interpretation by the tax advisory firm. The company explained it had commissioned a freestanding asset costing over 10,000 Polish zloty (approximately $2,500 USD). This asset was a life-sized, gilded likeness of a well-known politician.

The firm argued that a video created to document the unveiling of the statue and offer "special thanks" to the politician for "enterprise development" had a satirical and humorous character but was intended for marketing purposes. They claimed the statue, as a permanent fixture in their office, would encourage clients to visit and take photos with it, serving as a marketing tool on social media platforms as well.

However, the court determined that the expense did not meet the criteria for tax deductibility. The ruling emphasizes that even marketing initiatives with a humorous or satirical intent must demonstrate a clear and direct connection to generating business revenue to qualify for tax deductions. The court found this particular expenditure lacked sufficient business justification.
